We are recruiting for a Division Vice President & Litigation Counsel to join our Law Department in Louisville, KY.
The Division Vice President & Litigation Counsel ("Litigation Counsel") will report directly to the General Counsel and/or Deputy General Counsel and will serve as a member and work collaboratively with Kindred's legal team. The Litigation Counsel will lead the company's litigation activities, including internal investigations, and provide guidance and recommendations on such matters to the senior legal management. This position requires significant litigation experience in complex matters, including proficiency in handling e-discovery.
Manages the activities of outside counsel who defend or prosecute lawsuits involving the company.
Communicates to the General Counsel the status of the company's litigation in order to set appropriate financial reserves.
Evaluates new litigation, as it arises, and formulates appropriate responsive actions, including establishing a budget and achieving desired results within budgetary guidelines.
Reviews, negotiates reduction when appropriate, and approves invoices from outside counsel and expert witnesses.
Provides legal advice on procedures to prevent involvement in litigation.
Completes special projects, such as ensuring intellectual property rights are protected, document retention procedures, and others as assigned by the General Counsel.
Stays abreast of new and updated information concerning the company's business operations, Support Center structure and employee base.
Provide counsel to clients at all levels of management on actual and potential disputes, including proposing creative approaches to dispute resolution.
Understanding of substantive and procedural law pertaining to civil litigation
Excellent organization skills
Ability to formulate litigation strategy and supervise outside counsel
Ability to learn complex legal and operational requirements pertaining to the healthcare industry.
Strong written and verbal communication skills.
Ability to work with individuals at all levels of the organization.
Knowledge of state and federal regulations.
Approximate percent of time required to travel: 20%
Juris Doctor Degree
Admission to State Bar
7+ years of litigation experience in a wide array of matters in state and federal courts, including professional negligence, business torts, contract disputes, insurance coverage and intellectual property.
Healthcare industry experience preferred, but not required.
